Rapists Deserve Capital Punishment_1I am sure the esteemed Institutions of India are not going to take a blind eye to the rape situation we have in our country. Expect this topic in one form or the other.

Being a very sensitive topic, please make sure you do not ever loose control of your speech and vocabulary and inferences as it might not go well with the female participants as well as the evaluators. Like I said in my GD Tips article, learn to be assertive.

Now Focus on the points below:

POINTS IN FAVOUR:

  • Non-Capital Punishment in India is hardly a punishment : People do not stay in prison for very long. With political contacts or bribes, a bail can easily be obtained. A drastic change is required in our law and order system to establish fear of law. Even during trial, it should be non-bailable.
  • Against Humanity, against all religions and against the social norms : Rape is the worst form of crime as its against the very basic idea of civilization, humanity. We are not wild animals.
  • Fate of the victim : Its hard to imagine what the victim has to suffer in this male dominated society of ours. Rape is a social taboo. and the victim has to live the life close to that of an untouchable forever. How is this justice? Rapists don’t deserve to live.
  • Fear of the law : There is no fear of the law left in criminals. So there is a need to make stricter laws in order to establish the respect for laws in the heart and mind of the citizens. If law cant protect the mango people, who will?
  • Death penalty should have a correlation to the crime rate in a country where it exists. The rape numbers speak for themselves. According to Wikipedia, The latest estimates suggest that a new case of rape is reported every 22 minutes in India.


POINTS AGAINST:

  • Dropping Conviction Rate : The conviction rate of rape cases has dropped from 46% in 1971 to 26% in 2012. Even if Law is established, it Rapists Deserve Capital Punishment_2cant be enforced in India.
  • Commit one crime to stop other : Rather than death penalty, swift arrest and fast-tracked trial leading to conviction alone can instill fear of law in people and deter commission of crimes, be it against women or in general.
  • False Reports : The law can be misused in case of personal disputes and may lead to a even more chaotic law and order situation. An efficient judicial system is lacking in India due to corruption or whatever reason.
  • In past 10 years we have executed only 2 people under capital punishment. That doesn’t look very promising if you want to instill fear of law.
  • Educate : Majority of rapes reported in the media are by uneducated people. Parents/Teachers/the society/the government should take the responsibility to nurture young ones on the right path.

POSSIBLE CONCLUSION:

Capital Punishment has already been banned in most of the countries worldwide. It is by their example, we can say that Death  Penalty wont help in eradicating rape. However, from this discussion it is clear that we need stricter laws and efficient fast track courts to counter this increasing crime. Some social norms like dishonoring the victim also needs to be changed and that can be achieved only by education and awareness.

  1. Capital punishment is not just about getting "revenge" for the victim. It is about being a deterrent for others. Having the death penalty can make people think twice before committing crimes. It also costs a lot to have one person in jail each year. That is more one then the average income. This money could be spent on education, health and defense. All these are much better then spending money on someone who has killed or raped someone don't you think?

  2. i feel that capital punishment is not the solution for this problem. I feel that we indians make too many laws(very recently we came up with new laws regarding rape, stalking etc following the justice verma commitee recommendations) but are these laws really helpful? i guess not. because proper implementation doesn't take place. WE need to punish the culprits (say a person who has been convicted of rape) by giving them life imprisonment(solitary). it will instill fear among people. We should not give them bails when found guilty of such heinous crimes.let them pay the price of their deeds

  3. The convict/s who is/are proved to be the assailant/s should be punished with chemical castration and life imprisonment. Also, the victim should be compensated by the government.

  4. There is only one strong reason i think that capital punishment should not act as deterrent to rape.I saw a movie named "The lives of others" . In this movie a woman had been raped and killed by a previous classmate.There is a scene in which her husband talks about capital punishment for the rapist.His argument goes as follows: If death is given as a sentence to the person who committed the crime would he be subjected to the same trauma and pain that her wife went through? No he would be killed in an instant. Although i agree that currently those who get life sentence get out of jails easily but i think that enforcement of laws against easy bails should be made stronger.People who commit such crimes should be jailed and allowed to live but live in such miserable conditions that they become strong deterring examples to anyone who ever even thinks of committing such a crime.Also since a person is not killed it would provide chance to those who are falsely accused to defend themselves in case they are wrongly convicted.

    1. All death convictions take forever in India and your idea of "life first and then death", therefore, has happened automatically for Indian convicts for past 60 years. Has that instilled any fear? I dont think so.

  5. I personally feel dat if d accused is found to be guilty. ….
    he must be given d same level of physical torture which he did to victim. I.e injury to private parts or any other body organ….as mentioned on d injury report of d victim n if d victim is dead ….den d guilty shd also b given capital punishment. ….

  6. Capital punishment is not the solution for heinous crimes like rape or brutal murder. Punishment should be of a kind that create fear in peoples mind, life long imprisonment with adverse living conditions and making them go through the kind of physical pain which a victim experiences, could be a better solution. And awareness should be created amongst the people about these harsh punishments so that people think twice before committing such crime.
